Attorney Brett Zekowski Secures $8.38 Million Settlement for Construction Worker Seriously Injured by Falling Concrete

PORT WASHINGTON, N.Y., Sept. 28, 2026 /PRNewswire/ -- Parker Waichman LLP announces that attorney Brett Zekowski secured an $8,380,000 settlement on behalf of a 43-year-old construction worker who sustained serious injuries after being struck by a piece of falling concrete while working at a job site in New York City.

The case was pending in New York County Supreme Court and reached a settlement following jury selection, opening statements, and the plaintiff's testimony at trial.

According to the allegations in the lawsuit, the worker was performing his job duties at a construction site in New York, New York, when a piece of concrete fell and struck him in the back. The incident caused significant injuries to his lumbar spine, cervical spine and left knee.

The worker's injuries included a lumbar fracture at L2/L3, as well as multiple lumbar and cervical disc herniations. He also sustained a horizontal tear of the posterior horn and body of the medial meniscus extending into the junction of the anterior horn of the left knee.

The lawsuit alleged that the defendants failed to provide the worker with a safe place to work and adequate protection against the hazards associated with falling materials at the job site.
